Terms of Service

The agreement between you and Workaut for using the app, the website and buying programs.

In short

1. Who we are

Workaut is a fitness and training application and website (the “Service”) operated by Luis Tomás Castillo Romero, a sole proprietor established in El Salvador (“Workaut”, “we”, “us”). You can reach us at [email protected].

These Terms of Service (the “Terms”) are a binding agreement between you and Workaut. By creating an account, using the app or buying anything on this website you accept them. If you do not agree, please do not use the Service.

You must be at least 14 years old to create an account. If you are under the age of majority where you live, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf.

You are responsible for everything that happens under your account. One person may hold one account. You can delete your account at any time from Settings in the App or by following these steps; deletion is permanent and removes your training history, photos and purchases.

4. The Service

Workaut offers guided workouts, training Programs, nutrition and progress tracking, and a social feed where you can share your activity with friends you choose. The Service requires a compatible device and an internet connection; data charges from your carrier are your responsibility.

We continuously improve the Service and may add, change or remove features. We will give reasonable notice in the App before removing a feature you have paid for, and will refund the unused portion where the law requires it.

5. Premium subscription (iOS)

Premium is sold exclusively through Apple's in-app purchase system and is governed by Apple's Media Services Terms and Conditions. Subscriptions renew automatically at the price shown at the time of purchase until cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription from your Apple ID settings; Workaut cannot cancel it for you. Free trials, when offered, convert to a paid subscription unless cancelled before the trial ends.

6. Program purchases

Programs are sold as one-time purchases of digital content. When you buy a Program it is unlocked in your Workaut account and remains available for as long as your account exists, on every platform where you sign in with the same account.

When you buy on the Website, the transaction is with Paddle: Paddle charges your payment method, issues the invoice or receipt, and collects and remits any applicable sales tax or VAT. Workaut delivers the Program to your account. Prices are displayed in US dollars; taxes are shown at checkout before you pay, according to your billing country.

Programs are licensed, not sold: you receive a personal, non-transferable licence to use the Program within the Service. You may not copy, resell, share or redistribute a Program or its contents outside the Service.

7. Refunds

Refunds for Website purchases are governed by our Refund Policy, which forms part of these Terms. Refunds for purchases made inside the iOS App are handled by Apple under Apple's policies.

8. Creator Programs

Programs by Creators are designed by independent coaches who are solely responsible for their methodology and content. Workaut reviews every Program against its training rules before publication, but Creators are not our employees and we do not guarantee any specific result. Creators retain the intellectual property in their Programs and grant Workaut a licence to build, publish and sell them through the Service. Workaut is the only seller of every Program: it sets the price, provides support and handles refunds, and pays Creators a royalty under their agreement. Creators do not sell to you directly.

If a Creator leaves Workaut, Programs you have already purchased remain available in your account.

9. Health and safety

Workaut is a training and tracking tool. It is not medical advice, diagnosis or treatment. Exercise involves a risk of injury. Before starting any training or nutrition plan, consult a physician or qualified professional, especially if you are pregnant, have a heart condition, injuries, or any other medical condition. Stop immediately and seek help if you feel pain, dizziness or shortness of breath.

Nutrition features provide general estimates (for example calorie and macronutrient targets) and are not a substitute for individualised dietary advice.

10. Your content

You keep ownership of the photos, comments, workout logs and Programs you create. So that the Service can work, you grant Workaut a worldwide, non-exclusive, royalty-free licence to store, process, display and transmit that content within the Service, for example to show your workout photo to the friends you have chosen. This licence ends when you delete the content or your account, except where the content has already been shared with others or we must keep it to comply with the law.

You confirm that you own or have the right to share what you upload, and that it does not infringe anyone's rights or violate the law.

11. Intellectual property

The Service, including its software, design, logos, exercise library, texts, images and Workaut-authored Programs, is owned by Workaut or its licensors and protected by intellectual property laws. Except for the licences expressly granted in these Terms, no rights are transferred to you. “Workaut” and the Workaut logo are trademarks of Workaut.

You agree not to:

We may remove content and suspend or close accounts that breach these rules.

13. Privacy

How we collect and use personal data is described in our Privacy Policy. By using the Service you acknowledge that policy.

14. Third-party services

The Service relies on third parties such as Apple (App Store and in-app purchases), Google (Google Play), Paddle (web payments) and cloud infrastructure providers. Their terms govern your relationship with them. We are not responsible for services we do not control, and links to third-party websites do not imply endorsement.

15. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with notice where reasonably possible, if you materially breach these Terms, if we are required to do so by law, or if continuing would create risk for Workaut or other users. Sections that by their nature should survive (for example 6, 10, 11, 16 and 18) continue to apply after termination.

16. Disclaimers and limitation of liability

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.

To the fullest extent permitted by law, Workaut is not liable for indirect, incidental, special or consequential damages, loss of data or loss of profits, nor for injuries resulting from exercise performed with or without the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing in these Terms limits or excludes liability that cannot be limited by law, or the rights you have as a consumer under the laws of your country of residence.

17. Changes to the Service and to these Terms

We may update these Terms from time to time. The date at the bottom of this page shows the latest version. If a change is material we will notify you in the App or by e-mail at least 15 days before it takes effect. Continuing to use the Service after that date means you accept the updated Terms; if you do not, you may close your account.

18. Governing law and disputes

These Terms are governed by the laws of the Republic of El Salvador, without prejudice to the mandatory consumer-protection rules of your country of residence. If you have a problem, write to us first at [email protected]: we resolve most issues within a few days. Any dispute that cannot be resolved amicably will be submitted to the competent courts of El Salvador, unless the law of your country gives you the right to bring the claim elsewhere.

Purchases made on the Website are additionally subject to Paddle's Checkout Buyer Terms; purchases made in the iOS App, to Apple's terms.
